Know If I Have a Warrant

Take Defensive Driving

A driver’s safety course is a six hour course identifying and promoting safe driving practices. You may be eligible to take this course for the dismissal of your traffic violation.

The Financial Consequences of Getting a Ticket

Fines

Traffic tickets can have a lasting impact for drivers. With Texas now on the point system you can be faced with surcharges up to

$75000

on top of the original fine. You must also consider the possibility of higher insurance rates. For CDL drivers a ticket on your record can have even more far-reaching consequences.

Texas Point System

In Texas, the driver point system is called the Driver Responsibility Program or DRP. Under the point system, points are assessed for traffic convictions. Once the conviction has been added to the driver record, points are assigned and remain on the driver record for 3 years from the date of conviction.

2 points are assessed for a Texas or out-of-state traffic conviction.
3 points are assessed for a Texas or out-of-state traffic conviction that resulted in a crash.

NOTE: Points are NOT assessed for individuals who take defensive driving.

Individuals who have 6 or more points on their driver record are assessed a surcharge every year they maintain 6 or more points.

You may be able to lower your driving record points and dismiss traffic tickets by enrolling in a defensive driving course.

Surcharges amounts are:

$100 for the first 6 points on a driver record.
$25 for each additional point after 6.

Annual Surcharge

Individuals who receive a conviction for one of the offenses listed in the below will pay an annual surcharge for 3 years from the date of conviction. Points are not assessed for these offenses because the surcharge is automatic upon conviction.

No Insurance ticket = $250 per year for 3 years
No Driver License = $100 per year for 3 years
Driving While License Invalid = $250 per year for 3 years

License Suspension

The Texas Department of Public Safety can suspend or revoke your driver’s license for committing multiple traffic violations.

A driver license will automatically be suspended if an individual is convicted of:
4 or more moving traffic violations within a 12-month period, or
7 or more moving traffic violations within a 24-month period.

License Revocation

Individuals who have been convicted of at least two offenses for a violation that conflicts with a restriction or endorsement printed on their driver license are also subject to a suspension or disqualification.

Depending on the type of suspension you have, you may be able to contest the decision with a hearing or appeal. Contact the attorney to see if you qualify for a hearing or appeal.

Occupational License

If you license has been suspended, you may be eligible for a temporary occupational license, if you need to drive for:

Work.
School.
Carrying out necessary household functions.

Contact the attorney if you need to apply for an occupational license.

Insurance Costs

In addition to the penalties imposed by the State, insurance companies check your driving history and may increase your premiums or even drop your coverage if you have too many traffic tickets.

Why Hire An Attorney:

Avoid Hassles

Contesting your ticket on your own is time consuming and stressful. You will have to appear in court at the designated dates and times or the court will issue a warrant for your arrest. This means taking time off work or school. Hiring the attorney removes this hassle. The lawyer will take care of everything from start to finish and will go to court on your behalf so that you don’t have to.

Arrest Warrants

Failure to pay your traffic tickets or failure to appear in court will result in the issuance of an arrest warrant. Once an arrest warrant is issued, the only way to remove it is to post a cash bond or paying the fine. However, your lawyer may be able to remove your warrant without you having to pay anything out-of-pocket.

Defensive Driving Education

Traffic tickets for moving violations such as speeding or running a red light can be dismissed by taking a defensive driving course.
